About the event
Medical Freedom and basic human livelihood are in balance . The SC legislature called a session to hear H4560 on December 1st. We need to be there and we need to be heard. Each and everyone person deserves the right to determine what medical procedures they recieve.
"Stay is affirmed.
The court said: "The public interest is served by maintaining our constitutional structure and maintaining the liberty of individuals to make intensely personal decisions according to their own convictions—even, or perhaps particularly, when those decisions frustrate government officials."
What does this mean for South Carolinians?
If your employer was enlisting a mandate due to OSHA, the employer does not HAVE to mandate.
Currently, employers can still voluntarily require their employees to vaccinate. That would be of their own accord.
H4560 would prevent employers retaliating based on vaccine status and nullify any use of an immunity passport.
Federal contractors - we have not seen any lawsuits come up regarding the tension between state law and federal law. There is a potential that the one below may be helpful for this group. Until a law in SC exists, a situation that creates the question on what law would be preemptive doesn’t exist here.
Healthcare facilities in SC are currently facing their own mandate and that is being wielded by their contracts with CMS (Centers for Medicare & Medicade Services). For most facilities Medicare reimbursements apprise of at least 50% of their revenue and it has not been determined to our knowledge how these facilities will be penalized for their failure to comply. It’s our understanding that a lawsuit will be filed against the federal government in regards to this mandate in the next week."
